Coverage for Farm Workers: Required
Limitations: None. Farmworkers are not separately mentioned in statute.
Statute: Mass. Gen. Laws Ann. 152 ยง 1(4) (2012) ("farm laborers" are not excluded from definition of "employee" and history indicates the exclusion was removed)
Coverage for Undocumented Workers: Yes
Case Law: Brambila v. Chase-Walton Elastomers, Inc., 11 Mass. Workers' Comp. Rep. 410 (1997) (holding that being an illegal alien was not an absolute bar on receiving workers' compensation and worker who misrepresented his status to gain employment was entitled to workers' comp benefits).
