Coverage for Farm Workers: Required (with limitations)

Limitations: Employers must provide workers' compensation only if the employer had a gross annual payroll in the preceding calendar year of $100,000 or more in cash wages for agricultural and horticultural workers.

Coverage for Undocumented Workers: Yes

Case Law: Lang v. Landeros, 918 P.2d 404, 406 (Okla. Civ. App. 1996) (holding that there is no provision in Workers' Compensation Act that precludes compensation for an employee who is an illegal alien).

Benefits Available for Undocumented Workers: Undocumented workers are eligible for temporary total disability benefits. Cherokee Indus., Inc. v. Alvarez, 84 P.3d 798, 802 (Okla. Civ. App. 2003). Undocumented workers are also eligible for permanent partial disability benefits. Lang v. Landeros, 918 P.2d 404, 407 (Okla. Civ. App. 1996) (upholding award to undocumented worker that included permanent partial disability payments).
