Limitations: Employers who employ 6 or more employees on 20 days (does not have to be consecutive) during a calendar year whether in one or more locations must provide workers' compensation.

Case Law: *Note: Neither the statute nor regular case law discusses whether undocumented aliens are entitled to benefits. However, there was a case brought to the Labor and Industry Review Commission that resulted in an award of workers' compensation benefits to an undocumented worker. Rea v. Kenosha Beef Int'l, 1999 WL 370027, 4-5 (Wis. Lab. Ind. & Rev. Comm'n May 5, 1999).
Benefits Available for Undocumented Workers: Undocumented workers are eligible for compensation for medical expenses, as well as temporary total and permanent partial disability benefits. Rea v. Kenosha Beef Int'l, 1999 WL 370027, 4-5 (Wis. Lab. Ind. & Rev. Comm'n May 5, 1999) (affirming an award of income benefits to undocumented worker).
